3. Legal Basis for Processing

Under the UK General Data Protection Regulation (UK GDPR), we process your data on the following bases:

Contract performance (Article 6(1)(b)): Processing your name, email, company details, and uploaded media is necessary to fulfil your order and provide our services.

Legitimate interests (Article 6(1)(f)): We may use anonymised examples of delivered work in our portfolio and marketing materials. You can opt out of this at the time of ordering.

Legal obligation (Article 6(1)(c)): We retain financial records (purchase amounts, receipt data) for 6 years as required by HMRC.

4. Who We Share Data With

We do not sell your personal data. We share data only with the following service providers, who act as data processors on our behalf:

Some of these providers are based in the United States. Transfers are safeguarded by the UK-US Data Bridge (UK Extension to the EU-US Data Privacy Framework) or Standard Contractual Clauses where applicable.

5. How Long We Keep Data

Account data: Retained for as long as your account is active. If you delete your account, we remove your personal data within 30 days, except where retention is required by law.

Project files: Reference media and generated outputs are retained for 12 months after your last order to allow re-downloads, after which they may be deleted.

Financial records: Purchase amounts, receipt data, and transaction records are retained for 6 years as required by HMRC.

Chat messages: Retained for the duration of the project plus 6 months, then deleted.

6. Your Rights

Under UK GDPR, you have the following rights:

Access: Request a copy of the personal data we hold about you.

Correction: Ask us to correct any inaccurate data.

Erasure: Ask us to delete your data (subject to legal retention requirements).

Restriction: Ask us to temporarily stop processing your data.

Portability: Request your data in a machine-readable format.

Objection: Object to processing based on legitimate interests.

8. Children

Our services are intended for business professionals and individuals aged 18 and over. We do not knowingly collect data from anyone under 18. If you believe we have collected data from a minor, please contact us immediately.

If you are unhappy with how we handle your data, please contact us first at hello@omnivyv.com. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO) at ico.org.uk.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised policy.
